A new mechanism for regional MEAs has been launched in Ukraine, with the legal framework developed by the ARZINGER team. The first practical application of this mechanism gives patients access to modern, innovative treatment.

For us, this isn’t just important news – it’s the outcome of nearly three years of consistent work. The ARZINGER team supported the project at every single stage: from developing the concept and discussing it with key stakeholders to drafting legislative amendments, navigating the legislative process, liaising with government agencies, developing secondary legislation, and raising awareness of the practical implementation of the new mechanism. Over the course of the time, the team successfully navigated dozens of approvals, overcame regulatory and political challenges, and established the legal framework for launching the new model.

The new mechanism allows for the pooling of funds from the state and local budgets as well as of hospital funds to purchase innovative medicines under managed access agreements. This expands access to modern treatments for patients, particularly those with rare diseases, while also promoting more efficient use of budget funds, increasing procurement transparency, and advancing the development of Ukraine’s healthcare system.

The project came about through the joint efforts of our Life Sciences & Healthcare, Tax / Transactional and International Taxation, and Transport & Infrastructure practice teams.

We sincerely thank all stakeholders who contributed to the various stages of the reform: representatives of the Ministry of Health of Ukraine, the Ministry of Finance of Ukraine, the State Enterprise “Medical Procurements of Ukraine,” Ukrainian MPs, innovative pharmaceutical business representatives, the patient community, the regional medical community, and all other partners who supported the initiative. It is through joint efforts, open dialogue, and a willingness to seek effective solutions that we have succeeded in creating a mechanism that is already coming into play to benefit Ukrainian patients.
