The Monograph by Sergii Shkliar, founding partner, attorney at law, PhD. "Control over Compliance with Legislation on the Protection of Economic Competition in Ukraine: Problems of Improving Administrative and Legal Regulation"

The paper summarizes and analyzes modern theoretical and legal, regulatory, analytical, methodological and practical aspects of the administrative and legal regulation of control over compliance with legislation on the protection of economic competition in Ukraine. The general conceptual-categorical questions of the chosen problem are revealed and systematized: the essence and methods of state regulation of economic competition as the object of state control and administrative-legal regulation are determined. Considerable attention is paid to the disclosure of the control system for compliance with the legislation on the protection of economic competition: its principles, types, subjects and objects of such control are thoroughly investigated. The system of control over observance of the legislation on protection of economic competition is thoroughly investigated, the peculiarities of the administrative and legal status of these bodies are determined, the forms and methods of their activities are determined, and the peculiarities of the administrative and legal status of the Antimonopoly Committee of Ukraine as the subject of control over observance of the legislation are disclosed regarding the protection of economic competition. Taking into account the importance of harmonization of the Ukrainian legislation with the principles of the legislation of the European Union, considerable attention was paid to the analysis and study of international standards for monitoring compliance with the legislation on the protection of economic competition, and the best practices of foreign countries in this area were identified. On the basis of the investigated material the corresponding theoretical generalizations were made for further ways of increasing the effectiveness of control in this area and making changes to the current legislation were developed.
